Can I sue if I’m already getting workers’ comp?
Often, yes. Workers’ comp bars suing your own employer, but if a third party – a property owner, general contractor, or equipment maker – helped cause the injury, you may have a separate lawsuit on top of your comp benefits.
What is New York’s Labor Law 240, the “Scaffold Law”?
It holds owners and contractors strictly liable for many gravity-related construction injuries – falls from heights or being struck by falling objects – when proper safety protection was not provided.
How is a lawsuit different from a comp claim?
Comp pays limited medical and wage benefits no matter who was at fault. A third-party lawsuit can also recover pain and suffering and full lost earnings – but you have to show someone other than your employer was responsible.
When should I talk to an attorney?
